In a ruling published today, January 9, 2026, the Court of Genoa recognized Italian citizenship for our clients born in Brazil, descendants of an Italian ancestor.
This ruling is particularly interesting because, contrary to some decisions of a different orientation, it excludes that “the submission of an administrative application constitutes a condition for the admissibility of a judicial application, since the assessment of the subjective right to citizenship is based on a dual-track system.”
Therefore, in order to take legal action for the recognition of Italian citizenship, it is not necessary to first submit an administrative application (to the Italian consulate with territorial jurisdiction).
This is an important recognition of the right to Italian citizenship, a right defined by the Supreme Court as “permanent and imprescriptible.”
