With ruling no. 142/2025, published today, the Constitutional Court dismissed the challenges against the old Law no. 91/1992, reaffirming the position of both the Court itself and the Court of Cassation, according to which citizenship transmitted iure sanguinis is an original, permanent, and imprescriptible right.

The judges emphasized that the legislator is free to determine the criteria for granting citizenship status, provided that such criteria are reasonable and consistent with the Constitution; otherwise, those limits are subject to review by the Constitutional Court.

🟢 Those who started the recognition process before 27 March 2025 can breathe a sigh of relief: the procedures remain valid under the original rules.

🔴 However, attention should be paid to the new law (Decree 36/2025 converted into Law 74/2025), effective from 28 March 2025, which imposes much stricter requirements and will be subject to a constitutional review initiated by the Court of Turin.
